Data retention under the LSSI
GOBLINTRADER, S.L. informs you that, as a data hosting service provider and pursuant to Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information essential to identify the origin of the hosted data and the time at which the provision of the service began. The retention of these data does not affect the secrecy of communications, and they may only be used in the context of a criminal investigation or to safeguard public security, being made available to the judges and/or courts or the Ministry that requests them. Data will be disclosed to the State Security Forces in accordance with the personal data protection legislation.
Intellectual property rights of www.goblintrader.es
GOBLINTRADER, S.L. holds all copyright, intellectual and industrial property rights, know-how and any other rights relating to the content of the website www.goblintrader.es and the services offered on it, as well as the programs required for its implementation and the related information. The reproduction, publication and/or any use that is not strictly private of all or part of the content of the website www.goblintrader.es is not permitted without prior written consent.
Intellectual property of the software
Users must respect the third-party programs made available to them by GOBLINTRADER, S.L., even if they are free and/or publicly available. GOBLINTRADER, S.L. holds the necessary exploitation and intellectual property rights to the software. For any action beyond the fulfilment of the contract, users will need written authorisation from GOBLINTRADER, S.L., and they are prohibited from accessing, modifying or viewing the configuration, structure and files of the servers owned by GOBLINTRADER, S.L., assuming civil and criminal liability for any incident that may occur on the servers and security systems as a direct result of negligent or malicious action on their part.
Intellectual property of hosted content
Use of the services provided by GOBLINTRADER, S.L. contrary to intellectual property legislation is prohibited, in particular:
- Use that is contrary to Spanish law or infringes the rights of third parties.
- Publishing or transmitting any content that, in the opinion of GOBLINTRADER, S.L., is violent, obscene, abusive, illegal, racist, xenophobic or defamatory. Cracks, software serial numbers or any other content that infringes the intellectual property rights of third parties.
- Collecting and/or using personal data of other users without their express consent or in breach of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
- Using the domain's mail server and email addresses to send unsolicited bulk email.
Users bear full responsibility for the content of their website, the information transmitted and stored, hypertext links, third-party claims and legal actions relating to intellectual property, third-party rights and the protection of minors. Users are responsible for complying with the laws and regulations in force and the rules relating to the operation of the online service, electronic commerce, copyright and the maintenance of public order, as well as the universal principles of Internet use. Protection of hosted information
GOBLINTRADER, S.L. makes backup copies of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the full restoration of data deleted by users, as such data may have been deleted and/or modified during the time elapsed since the last backup. The services offered, except specific backup services, do not include the restoration of content kept in the backups made by GOBLINTRADER, S.L. when the loss is attributable to the user; in this case, a fee will be set according to the complexity and volume of the recovery, always subject to the user's prior acceptance. The restoration of deleted data is only included in the price of the service when the loss of content is due to causes attributable to GOBLINTRADER, S.L.
Commercial communications
In application of the LSSI, GOBLINTRADER, S.L. will not send advertising or promotional communications by email or any other equivalent electronic means of communication that have not previously been requested or expressly authorised by their recipients. In the case of users with whom there is a prior contractual relationship, GOBLINTRADER, S.L. is authorised to send commercial communications about products or services of GOBLINTRADER, S.L. that are similar to those originally purchased by the customer. In any case, users can ask not to receive further commercial information through the Customer Service channels, after proving their identity.
